Senate Bill 74: Workplace Immunization Prohibition

The Worker’s Rights bill that we have been working as a team is now officially in the Senate Pensions and Labor committee. THIS IS FANTASTIC NEWS!!!

Here is a synopsis of the bill: Workplace immunization prohibition. Prohibits an employer from requiring, as a condition of employment, an employee or prospective employee to receive any immunization if the immunization is medically contraindicated for the employee or receiving the immunization is against the employee’s religious beliefs or conscience. Allows for a civil action against an employer for a violation.

Current Indiana law allows for personal beliefs exemptions for flu vaccines for certain healthcare employees. You can simply say no, but several Indiana hospitals still deny exemptions, create religious challenge tests, and harass employees who decline. This bill will ensure that all employees will have the basic human right to decline an employer mandated vaccine that is against their conscience. This year, we saw several major Universities require the flu vaccine for staff. It goes to reason that the covid-19 vaccine will also be required once the FDA gives it full approval. Employers and schools cannot require vaccines that are under emergency use authorization, but it’s only a matter of months before the FDA gives approval. Factories, warehouses including Amazon, meat packers, grocery stores, retails stores, universities, schools, and healthcare facilities will be able to require vaccines. We already saw this employer mandate happen with flu vaccines this year. Employers don’t need a state law mandating vaccines, they can require vaccines on their own.

What happens next? The bill will get a hearing and a vote in the Pensions and Labor senate committee. After it is passed, it will go to the full Senate for a vote of all 50 Senators. Then it will move over the House in their Labor committee for another hearing and committee vote. The public can testify at the Senate and the House committee hearings. This year public testimony for the Senate will be at the State House in a separate room from the committee meeting and delivered via video link. When the hearing is scheduled, we will notify you. It could happen as early as next week.

What can you do now? You can call the members of the Pensions and Labor committee, especially if you are in their district, and ask them to vote “YES” for SB 74. Calling is easy. Tell them that you want to see SB 74 passed and ask them to vote yes on the bill.

This is a list of Senators on the Pensions and Labor committee who might not be as supportive, but you can call and ask them to support SB 74. This bill will also help ensure fewer expensive EEOC lawsuits as it will make exemptions clear cut.

For people who have been writing in and saying that they don’t work, so this bill is not helpful to them….PLEASE help support this bill even if you don’t work. If we can get this passed, it sets a standard for ensuring exemptions. At the moment, Indiana’s governor has said that he does not plan to make the Covid-19 vaccine mandatory across the state. The plan is to use “other” avenues such as employment, travel, and entering venues to enforce compliance. If employers can be convinced to require vaccines, this will directly cut off the source of income for those who decline. That is the most powerful way to enforce compliance-cut your funds. This is one step in the right direction for freedom.

I also encourage you to read the Indiana state Constition to know your rights.

The Indiana state constitution guarantees our inalienable rights including religions beliefs and rights of conscience.

    1. SB 74 died, the republicans got together behind closed doors in caucus and decided to kill the bill….here we are now being mandated all over and they claimed that would not happen. We need a new bill again this year and so far nobody has agreed to write it
